In these terms and conditions “We/us/our/New Leaf TopiaryLtd /newleaftopiary/newleaftopiary.co.uk” means www.newleaftopiary.co.uk, “Website” means the website located at www.newleaftopiary.co.uk (or any subsequent URL which may replace it) and all associated websites and micro sites of newleaftopiary. “You/your” means you as a user of the Website.
You shall not use the Website for any illegal purposes, and you will use it in compliance with all applicable laws and regulations. You agree not to use the Website in a way that may cause the Website to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the Website is in any way impaired.
You agree not to attempt any unauthorised access to any part or component of the Website; and You agree that in the event that you have any right, claim or action against any Users arising out of that User’s use of the Website, then you will pursue such right, claim or action independently of and without recourse to us.
We reserve the right to modify or withdraw, temporarily or permanently, the Website (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website.
We may alter these terms and conditions from time to time, and your use of the Website (or any part of) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.
The Website is subject to constant change. You will not be eligible for any compensation because you cannot use any part of the Website or because of a failure, suspension or withdrawal of all or part of the Website.
Basis of Sale
By purchasing plants from New Leaf Topiary you are entering into a legally binding agreement with us on the terms shown below. We advise you to read and understand these terms because they affect your rights and liabilities.
The description of the Goods, the price, VAT and delivery costs are set out in the relevant website ordering pages. We aim to give you a clear idea of the Goods you will be purchasing. Please note that the products may vary from images emailed or shown on the website, plants are living products, each with their own individuality. All dimensions given are subject to +/- 10% tolerance. Illustrations and descriptions are for guidance only. We may occasionally have to alter the nature of the Goods, this is at our sole discretion and of course will be avoided if at all possible
Legal title to the goods will not pass to the customer until the company receives full payment. Should the purchaser appoint a receiver, liquidator or trustee in bankruptcy, having disposed of the goods to a third party, then the proceeds from the sale of goods shall be used to satisfy the company's account.
Order Cancellation
Should you wish to cancel an order, this must be made in writing (via email) to New Leaf topiary at info@newleaftopiary.co.uk at least 48 hours prior to the agreed delivery date (if one has been determined).
Delivery Policy
For all orders you should allow 5-10 working days from the date of order for delivery. For plants above 200cm then please allow up to 21 working days for delivery.
This is an approximation of a realistic lead time, yet we will of course endeavour to deliver your order as soon as is possible and convenient to you.
Most parts of mainland UK are covered by our free delivery, however there are occasionally some postcodes including areas of Scotland where we will be unable to deliver products over 200cm, please contact us prior to placing an order if you wish to confirm that we are able to deliver to your postcode.
Arranging Delivery
Following email notification from New Leaf Topiary that your order has been processed, we will contact you by phone to liaise regarding a suitable delivery date.
Deliveries are undertaken from Monday to Friday only, with the exception of Bank Holidays.
We currently only deliver to UK mainland (not N.I), for charges to I.O.W please contact the Sales team on 0125740 1193.
Delivery will be made to the address as specified in your order, Your delivery address must be accurate as we will not accept liability for any incorrect delivery or damage do the Goods made as a result of the wrong information being given.
If you wish the goods to be delivered to a third party, you must make this clear at the time of ordering, and provide us with accurate delivery information. In the absence of clear instructions, the goods will always be delivered to the billing address.
Although every effort is made to supply throughout the UK we reserve the right to refuse delivery, in this instance the customer will be notified and if the customer has completed payment a full refund will be given.
For large sized tree orders, we strongly recommend that suitable machinery and professional grounds people are lined up for the installation and delivery of your plants/trees(s). The plants are likely to be delivered on a 7.5 tonne lorry, with the use of articulated or flat-bed lorries where the order requires and/or access allows. The plants will be delivered to the point where access allows, except for large sized tree orders in which machinery will be required at the point of delivery to facilitate movement to the nearest flat, concrete surface.
Responsibility for loss or damage to the Goods will pass to you at the time of delivery or at the point at which delivery was attempted if you are absent at the agreed time. The Goods will only be your property once full payment is received.
We will do our best to deliver as per the delivery date quoted to you but this date is by no means guaranteed. Occasionally due to reasons out of our control delivery on the agreed date will not be possible, on such occasions we will notify you and agree a new delivery time.
Replacement Policy
At the time of delivery, please check your order and if you believe your goods have been delivered damaged,
are not of the correct quality, are incorrect in number or do not comply with their description,
New Leaf Topiary must be notified by the customer verbally within 24 hours of delivery of the goods
and confirmation in writing by email within 3 days thereafter so that where possible we can rectify the problem for you.
Failure to do so will deem those goods as being accepted by the customer.
If the plants are planted this will deem those goods as being accepted by the customer
and therefore unreturnable New Leaf Topiary take the utmost care to ensure that at the time of delivery
all our products are in a healthy and prime condition.
To ensure that your plant(s) remain healthy so that they can become established in your garden
it is essential that you water and maintain the plant(s) correctly from the moment your order is delivered.
No responsibility is accepted for replacement of failed plants as we are unable to control the planting,
soil condition, weather, watering and/or ongoing maintenance.
Buyers shall be deemed to accept the above conditions as a part of the Contract of Sale by placing an order with us.
None of the above Terms and Conditions shall be deemed to be waived or modified unless expressly agreed by New Leaf Topiary in writing.
The laws of England shall govern the contract.
We reserve the right to make changes to this website at any time without prior notice.
These terms and conditions do not affect your statutory rights as a consumer.
